Excuse me...What do u wanna ask the USCIS? U wanna put ur hand where it dozn't belong to? Good luck with that!!! I dont mind so many red dots. But I just wanna make my point. Just imagine one thing... U have a family. Someone from the outside doesn't like the way you are treating ur wife and asks u to divorce ur wife. How wud u feel? U r a NOBODY. Dont u get it? U just cant change a foreign land's system. Protest, conduct rallies...thats fine. But u have no rights to dig and delve into how USCIS is functioning. U R A NOBODY.

This is the worst DMV in NJ... You may be better off going to Jersey City, Princeton or anywhere else.
Princeton/Trenton are also worst...FYI...My DL already expired on 9th Sept.
I went to Trenton with original receipt and employer letter but still they refused to renew my license.
My attorney forgot to upgrade my H1 application to premium process and then started to defend himself by saying that he did not get any approval from my employer and at the same time he never told me that he did not get my employer authorization till Sept 11th where as I asked him to upgrade to premium sometime in last week of July'07. So from July to Sept'11th he kept making excuses one after another but never mentioned that he needs an employer authorization.Thats how these attorneys work and screw our lives....

It's hard to believe that folks dont know anything about the Green-Card process when they come in. Let us say that you are right on, but they would have eventually figured it out by the end of couple years. I believe it is the situations like layoffs, move from one company to other for better prospects and salary will make them to enter the process late. It is their personal choice and I don't question that. But I believe they had options to apply for GC early in the process and they did not. So why penalize others who did before them. Please don't think Iam saying this because I entered late. I came during early 1998 and I did wait for 4 years to apply.
It is not about being lethargic, it is about company policies and options available to employees. Many times the Labour applications are delayed by the companies on the pretext of impending layoffs or on the fact that there was no written offer on processing GC at the time of employment offer.IN many cases this happens inspite of verbal assurances at the time of employement offer. Sometimes these verbal assurances keeps going on for years but the process never gets truly started. Many comapnies prefer I would say to start the process late so that they can hold on to the employee for longer period of time... Several reasons contribute to the LC being filed late. If and when LC is filed use of H1 B Start date of employment as priority date should put and end to these practices.

My friend EB2 is all ONE category. Please see the OR in that sentence.
to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.
Its sad but its going to apply for all EB2 applicants.
This draft memorandum was released today for comment until September 3, 2010 when it may be adopted as an official memorandum revising Adjudicators Field Manual. It touches the issues of evidentiary criteria for adjudication of I-140 immigrant petitions in EB-1A(Extraordinary Worker), EB-1B(Outstanding Professor or Researcher), and EB-2(Exceptional Ability), requiring two-prong test in the adjudication.

First of all congratulations to ind_game.
Today I received NOID for not submitting AC21. My I-140 is not revoked. I received an RFE last month for birth certificate & updated g-325a form. In the g-325a form I mentioned my current employer which would have triggered NOID for AC21.
I left the GC sponsored employer after 9 years on May 2008 well after 180 days and joined an insurance company. The company got hammered by financial crises. So I left that company and joined other stable company on Dec 2009 as a full time employee.
My current job description is similar to the one mentioned on ETA but not same. I am not sure if changing 2 jobs will be a problem.
If anyone had submitted any documents for AC21 please share. I will really appreciate it.

Thanks for your thread on this Pappu, I was just about to create this thread.
So here goes the first draft:
>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>
Dear XXXX,
Thousands of SKILLED LEGAL professionals, such as Scientists, Doctors, University Professors, Engineers, MBA's, Health Care Professionals and other professionals from all over the country who have contributed billions to the US ecomony are planning to participate in an unprecedented rally in the nation's capital on Tuesday, Sept. 18th to draw the attention of US lawmakers and American public towards excessive delays and backlogs in the Employment based Immigration system.
A group of rally participants from [your state] is meeting with Senators XXX and XXX with the hope of taking their help in supporting legislative changes to the Employment based Immigration system.
This peaceful rally is being organized by Immigration Voice (http://immigrationvoice.org), a grass-roots advocacy group of high-skilled legal immigrants.
For more information, please visit the following links:

//http://www.touchdownusa.org/RallyCentral/WashingtonDCRallyPressRelease.pdf
//http://www.touchdownusa.org/RallyCentral/WashingtonDCRallyPressRelease.doc
Since this is an unprecedented event from a very quiet group who have always remained in the sidelines of the recent Immigration debates, please provide visibility to this event so the plight of these law abiding, tax paying, highly educated people is spread among a larger group of people that would help drive the required legislative changes.
>>>>>>>>>>>>>>>>>>>>>>>>>>>>>
State coordinators, please take up this responsibility and work with your team to get this done. I will be coordinating with the people in NH and MA. Lets fire off on all the cylinders now for the final big takeoff...

I thought about posting my case details and now the complaint has been filed feel it is only fair to share with others as my case could set a presidence for others
I will keep story as points for ease
1. Husband moved to the USA in 1998 on L 1 inter company transfer
2. In 2000 company applied for I 140 for husband and approved May 2001
3. Within one year of I 140 approval, husband submitted I 485 for himself and youngest son. At the same time filed I 824 for son who was living abroad and was to follow to join once degree was finished. per I 485 instructions which still state to follow this procedure if minor child abroad.
4. Son abroad became 21 years in April 2002 and also subject to patriot act.
His I 824 was pending at enactment of CSPA.
5. In Oct 2002 we received a denial letter for 1st I 824, this letter did not say "aged out" just said re submit new I 824 once husband received his green card (so no final determination )
6. May 2004 submitted new I 824 for son abroad, this was approved Aug 2004
7. As no news from consulate by Jan 2005, sought assistance from Congressman Weldon. Eventually in Oct 2005 (via e-mail) The American embassy in London advised congressman my son aged out
8. After many consultations with different attorneys, who all said son was protected under cspa, started to get file together to file complaint.
9. Had difficulty finding attorney who understood the cspa well enough or willing to challenge.
10, In early 2006 husband became unwell and passed within a matter of a few weeks
As husband (the petitioner ) passed away I thought all hope was lost. Thanks to reporters printing my story an attorney came forward and offered assistance. All assets were frozen but the attorney kindly took case on a pro- bono
The complaint was filed March 2007, on the basis the first I 824 was denied in error.
The cspa is not retroactive as a rule and son is covered under limited exception as I 824 was filed before he was 21 years and pending at enactment of cspa.
There has recently been a new cspa court case that has approved a retroactive case, so there is hope for us all

None of the organizations succeed without making people accountable for their actions or inactions. This is true in the case of IV as well. We are all individually accountable for the current state of affiairs at IV, either good or bad, and we must accept or atleast acknowledge that before looking for solutions.
Before going for big ticket items like leadership change, elections and other politics let us focus on what we can improve instantly or in the near future. We all know that in the immigration process, there are only few factors or variables we can control, and rest lies with employer or DHS or USCIS or U.S. Government. One thing we can control is how we can improve our actions so that our voices will be heard to those who can act on our behalf. The list includes legislators, senators, media and local immigration community based organizations.
As a first step, let us add 'ACTION ITEMS' tab on the menu of IV home page. This action items tab will have list of 'to-dos' by all members on a monthly basis. These simply include, say, in July-09, every member should send one fax to local legislator, or write a letter or e-mail to media organizations like CNN, Business Week etc. We may do the same thing with different but similar content based on how events un-fold on a monthly basis. Now, the leadership with the help of other volunteers should come up with monthly agenda, and provide tools like - format of letter, content etc. The other member should just have to follow.
I will conclude with a quote from Anthony Robbins (great leadership coach): "Your life will not change by reading or listening....your life will only change by action". Let us make every one accountable in this process.
