Thank you very very much fightnow and gsc999 for pushing this forward. As soon as we have confirmation of date and time and location/route, I will send out newsletters to all CA, NV, AZ and OR members who wish to participate. This is going to be good.

Also, I will email all Bay area newspapers and tech periodicals that legal skilled immigrants are having to run rallies on the street instead of designing the routers and the next iPhone.

I have a question regarding the 180 day rule. I am a July 2nd filer, got EAD and AP and did my FP. my I-140 was also approved in oct 2007. So, I will be meeting the 180 day rule and I-140 approved criteria in jan 2nd,08.

Can I change job after Jan 2nd or I have to wait for 180 days from the time of 140 approval date. I think if its from 485 receipt date, I do meet 180 days rule and am safe to move on with another job/employer.

I know this question should had been asked by other members also, but I don't want to search all threads.

Looking for some genuine answers instead of thread bashings.

sparklinks - I got card production ordered email today and LUD on EAD cases online. I sent a request for inquiry thru immigration staff of my Senator (Sen. Kennedy - MA) three days ago. Not sure if that had any role to play in EAD approval.

Check your status and update as our cases were identical. I'll update details of duration of EAD renewal when I get physical cards.

My I-485 was delivered to NSC on June 26th. I-140 is approved from TSC. I did not get my receipt yet so I talked to my attorney, she said the case may be transfered to TSC. TSC receipt completion date 6/26, considering the tranfer time of 2 more days we may get our checks cashed by this week. I hope this become true!

My I-485 was received by NSC, on Jun 25th. Called USCIS today, they said information is not in system. Lawyer is also not repsonding, if checks are cleared. My previously approved I-140 from TSC has a LUD of 08/05/07.

Did you know I-140 dates are prtable from X to Y after 140 is approved? I am sorry to hear your pain, but you can check if you can atleast maintain your priority dates.

Are you sure about that...never heard of I140 portability. If it were true...why would there be such a big ho ha about AC-21.

Iam a novice at this, and am by no means contradicting your point...just skeptical..

Section 202 of the Immigration and Nationality Act (INA) states that the per-country limit for preference immigrants is set at 7% of the total annual employment-based preference limits. This means a country with large population like India and a tiny country like Lichtenstein get same number of visa numbers. This system is designed to systematically discriminate people from India and China by preventing them from attaining employment visas. More research needs to be done whether this constitutes a violation of US Equal Employment Opportunity Law. We need to find out whether this constitutes discrimination by national origin. Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

Switch to EAD...and stop worrying about GC

Ok now.... Here is something interesting.

Who said ? Lawsuits will not work. If you guys have any doubts ? Follow the links below, iam gonna paste. It will tell you how powerful lawsuits are in this country if you think you have been fooled over and over on false promises. This is especially true in the case of People whose priority date was current for a long time but still they were made to wait because of unknown reasons by USCIS while the folks who had priority dates as recent as 2006 walked with Green Cards. People especially who fall under this category are sure to succeed only by filing lawsuits. I dont see any other way out here.

Hasnt the issue of processing order been beaten to death?

I understand the momentum here....not trying to rain on a parade or anything...but shouldnt we be a little practical. How long is litigation going to take? Wont only naive lawyers even take this up?

USCIS can always pull the security reason trump card here.

moreover, during the last quarter...in the effort to not waste visas, low hanging easy to approve cases with later priority dates have gotten approved. wudnt u rather have that than visas going waste?

We have been patient for a very long time....lets see how the dates move in the 1st 2 quarters of fiscal 09.

My personal suggestion....stop worrying aout GC...there are much bigger things in life to worry about. :)

Republicans want nothing to do with CIR . SKILL bill is out there but the Republicans wouldnt want to touch that topic as they would like to help the President with important issues like "spending" keeping in mind that he wouldnt have the support of the Congress that he used to enjoy for the rest of his term. This means nothing in the lame-duck session.

Democrats on the other hand (if they have the House) wouldnt want "stop-gap" measure for immigration. They would want to go the whole 9 yards keeping the 2008 Presidential elections in mind. This means we would have to wait till the next Congress resumes office.

Any comments ??

Dear admins,

I think deleting my post was not fair. The other people who have been bashing us with MS degrees need to also have their posts deleted.

I was not offensive in anyway, I just pointed out the reality of the situation and that is not "being offensive."

If you are afraid of alienating some of your contributors, well then by deleting the posts of ppl with Masters degrees you risk alienating them.

If I offended the admin personally if he/she does not have a masters degree, I apologize for hurting your "feelings" but that does not allow you to delete my post .

Finally, since 99% of the time the admins come back with not relevant to the thread, I agree on that ground but respectfully request the deletion of posts by a bunch of others like the "hiring manager" who instigated this discussion.

Admin:
Can you also delete posts where there was some bashing of people with advanced degrees, just to make it fair? I think the whole thing was started by the guy (GCsucks) by addressing people who attend U.S universities as "Kids" and I agree with "yabadaba" that this is reality and we were just pointing out what the issues are. If it's a case of sour grapes then may be that guy should vent his frustration else where or easier GET HIMSELF AN ADVANCED DEGREE IN THE U.S

I used AVR (Automatic Revalidation Rule) to get back to US. If u have an expired stamp and a valid I-797, u can show ur PP alongwith original 797 and they'll let u in. But if u have used AP to re-enter before, u will need to use AP to enter US after ur landing. That being said, I know atleast 5 cases in the recent past who came back to US successfully using AP after their Canadian landing. I agree its a risk but most of the cases cud be hear-say. Just act innocent and that u dint know about the risk if at all u get questioned. Again, when the law permits u, why shud they question? Also, u still dont have ur US GC in ur hands...so let them know of it in a nice way if they harass u. Tell them that once u get ur US GC u will give up ur Canadian PR.

It is easier said than done. When you are entering you are at the discretion of IO and you do not know all the laws. In this particular case, the people tried to convince IO that they were planning to let canada PR go once they receive US GC but the IO was determined to revoke their AOS. So there is nothing really you can do at that point in time.

Just got my checks cashed for I-485. I did not apply for EAD or AP with my 485.

Btw.. I did not have my medical exam and used the wrong G-325 form but still got receipted. I hope the second application I sent in does not cause any issues. :(
