My wife's 485/EAD/AP checks got cashed today. Biometric check not cashed yet. Although when I enter the receipt number in the USCIS website, couldn't find the case . :confused:
All receipts number(from back of check) start with SRCxxxxxx, which means Texas i guess.

I do not believe that we should punish children for their parents' actions. For many of them, the United States is the only country they consider home. OK. So now we are fighting between EB2-India and EB3-India, are we?

The point I am trying to make is that things will not improve if we point at each other...IV is a place to come together and fight.
If you read all my posts you would realize that I pointed this issue out in May (trying to predict what would happen to EB3 based on their interpretation). An something needs to be done for EB3 as many people are stuck with their families for several years. All I am trying to urge everyone is to come together and think of a concrete plan rather than doing the "word battle".
Once such plan would be to think what type of EB immigration policy change would we advocate in proposed CIR. (again I am sure discussion about this will heat up when "horses are out of barn"; but I think this is the right time to do it) CIR will surely come again on the floor after elections. We need OUR strategy for it...do we have one??
A strategy that would benefit everyone : may it be EB1, EB2 or EB3.
This is all about looking forward...
And with all honesty, any amount of campaigning from IV or any other organization is not likely to change August bulletin and what USCIS and DOS has planned to do in next couple of months. I have information to support this statement and I will post it soon.
What we can do is to change the law for good with CIR. For that we will need strength, if EB3s leave IV, we will loose our own strength.

Hello everyone
Wanted to let everyone know of my experience. I dont physically have my card, but there is an approval notice on the USCIS website.
Priority date October 20th 2005
I opened a service request on Monday August 16th. The person on the other end of the line was extremely polite and nice. I told him I had a speaking engagement in Canada (which is the truth) and that if my case was expedited, I would not have to apply for a visa. He given me a SR number and asked me to wait for 30 days which I was prepared to do. However my case status changed online on August 19th. I am unsure as to whether this was because of the service request or things would have taken this route anyway.

Good point, has anybody asked this to any lawyer ? Can we challenge this in court ? This is the definition of judiciary review...If we can proove the country cap to be unconstitutional..
Judicial Review is when the Supreme Court reviews an act of Congress to see if it is Constitutional.
Judicial Review is the power of the Supreme Court to declare a law unconstitutuion (violation against the laws of the Constitutuion).
Do we have any reference to say it is unconstitutional ? If EB country cap is unconstitutional, FB cap would be unconstitutional too.
IMO this entire country cap rule has racist intent. If the caps were to promote diversity, the cap should be based on ethnicity of US population (ctizens and GC holders). Are Indians and Chinese a a mjority in this country ? No.
How does putting a cap on total visa allocation per year promote diversity ?

I agree that we need to strengthen IV by contributing our time, money. But, to me it looks like most of the successes(how small they are) of IV are making EB3 suffer more. Not anything against EB2 guys, don't start a war please. I think IV should concentrate more on EB3. I have seen vocal EB2 people writing against EB3 in these forums. But do we really have to suffer like this?
I agree completely with vdlrao and pappu. We are doing our best to put lot of efforts to sort this out by volunteering. What is your guess, how many people stuck in GC mess in the DC Metro area? Thousands, right????? We had a State Chapter meeting for Maryland, Virginia and DC and you know how many show up for the meeting ????? Take a guess...15!!!! You guys just know how to yell and scream at this blog. Convert your anger into something constructive......IV is not the President of this country that would go ahead and pass legislation to bring you relief. It is the lawmakers.....This has to be collective effort. I will like each one of you to first donate, volunteer before coming to this site to blame the organization. You should be thankful to the people running this show putting their time and energy for our cause. President of this country is having hard time to pass a legislation on health care and you expect IV with help of couple of people can get you legislative relief with couple of hundred dollars!!!! Guys wake up to the reality and contribute to IV.....Work with your state chapters...There are lot of people ready to take initiative through your state chapters but they find no one supporting them. There was and continues to be lot of discussion around multiple 485s. When USCIS is adjudicating a 485, they look at other pending 485s and cancel them. I had two 485s - 1 on EB3 and the other EB2. EB2 became current recently. They approved the EB2 one and rejected the EB3. So you can have multiple 485s.

From legal point of view, Employer has no legal obligation to file H-1B for any job applicant. Infact, employer can chose not to file H-1B extension for current employee.

Call USCIS and enquire about your card and also verify if your address in their system is correct. Also, get an appt with local USCIS office. All the best!!!
Called USCIS couple of times but I did not get the right response till now. They used to end the call abruptly.
But just now I called again, she told that they need to upload the Biometrics from CSC and she will do that. She told that I will get the card in 30 days...may be the regular time which they mention.
And she told not to take any Infopass appoitment and just to wait for 30 days.
