When i have to make my hands wet anyway - how about sending the resignation letter via a Lawyer along with Points that goes against the agreement ?
That may silence them and it will cost me 2-3 grands hardly - what do you say.
1. Is there any notice period mentioned in the agreement?
2. I am not sure if sending resignation letter by lawyer is a good idea. It seems that you hate him big time.
3. Sending a letter with points against agreement may or may not work. Depends on lot of factors (like how much money they are making thru your contract).
4. If they sue you, you could lose more than 10,000 (include time and peace of mind).
Not a legal advice.

Apparently you completely missed the point. I am asking core members to participate in discussion on these forums, not to put sensational headlines that excites people. Hope that helps.

It involves but not limited to funding drive to sustain and grow efforts, membership drive to grow in size and have impact of numbers, generating awareness and building support via media articles. Speculating will not help much. Pls. do participate in these drives in order to build momentum for the coming months and we will all have better chances for any legislative change. We are all in this together and we all need to work hard to enable a change

I140 or H1-B is another story, but, I485 is solely your application. You are entitled to talk to the attorney who sent your application (and put his/her name as a contact to USCIS) BY LAW. For I485 he/she is representing you, thus have to reply to your inquiries. It might even be ILLEGAL for the attorney to give info about your I485 to your employer.
How you can make your employer convinced about this? You might show evidence. Your initial aggrement with the attorney will help, too.
Too much of patience needed for this. My lawyer sent the papers on july 2nd. Still no word about the Receipt notice. I can see an LUD on July 28th on my approved I140. my 140 starts with SRC.... Anyone similar to my case.

On the one side you have the EB2. Earning more, and better educated. Clearly more important human beings to IRS and society. On the other we have EB3 Junta trying to get what they think is their right to spillover.
Now I understand all your points and agree with all of them.
Only 1 question :D why is IV not fighting to increase the regular (non spillover) quota for the clearly better category EB2. This is clearly not fair such super humans having to share same numbers as lower categories. Lower categories should go to Bombay where there is one apartment which is still empty.
Or better still get rid of the EB3 category altogether. Problem is solved! :D

I think a GC app is for a futute position. So getting promotions should be ok. I have seen comments stating otherwise here in the forums. What is true?

1) If the dates have retrogessed to 01/2000, that means that there are atleast some cases of 2000 that have now been cleared for processing and will be dealt with first before the rest.
2) It also means that there are sufficient numbers of these to have caused this problem. The numbers might be sufficient to use up all of this years allocation?
3) once these severely backlogged cases are cleared may be we can see some forward movment?
Either way this certainly adds a couple of years to the already 4+ years of average wait. Without much exact information from the USCIS we can do nothing other than start the next prediction:D
For sure legal alternatives wont help. the country cap is to ensure equal opportunity for smaller countries which dont have enough infrastructure as large countries such as India/china. We cannot expect the country cap to be removed.

I think the point raised by nousername is valid. Out of three people applying for fresh h1 only one gets it through lottery. H1 is only intended for fulltime job. After one fulltime job you can have multiple H1 for part time jobs. So if a person without a job offer is selected through lottery then it is unethical. It's not legal in H1 status without proper wage. So it is always desirable to apply H1 when you have a concrete job offer where the employer is willing to pay as soon as you apply for H1.

I applied for my EAD and AP renewal on the second week of May 2008. Again, I am not sure if EAD or AP renewal triggered the FP notice. Good luck to you.

But I can assure you that EB-3 ROW has very little hope. My estimate was that EB3-ROW's wait times were around 5-6 years.
But now, I have a feeling, that its going to be more like 10+ years. And 10+ years is a long time. Some sort of reform will happen in the next five or six years, and even that reform is not likely to get us greencards, since it may emphasize the family-based applicants.

in trouble. I am not on H1 but I think the moment you get H1, in this case COS from H4 to H1 within few months you should have paying job. There will be problem at time of extension if no paystubs are present. Bench or not employer need to Pay H1b if he has hired one.
But as of now he is not paying me any thing. so is there any thing that I can do about it?

It seems that the delay was cause by the USCIS itself. It should have made known to applicants where to "correctly" send the application such as if your I-140 was approved in TSC, send your application to TSC. What happened was a lot of applicants sent their application to NSC, but was transferred to TSC. This cause a big delay in Receipting.
My application was sent to the right Service Center. Therefore, I believe, this resulted to my Receipt Notices being received according to the USCIS Receipting Update.

Did anyone see Byron Dorgan's (Democratic Senator from North Dakota)interview on Stephen Colbert last night? This guy just wrote an anit-outsourcing book (http://www.amazon.com/Take-This-Job-Ship-Brain-Dead/dp/031235522X --no I am not plugging his book!) and he is full of 'they stole our jobs' rhetoric. Why is it not easy to change from EB3 to EB2?
We have to decide what is important in life for us. Current job/salary/promotion/ status quo or Geeencard?
If someone wants EB2, they can change their job and apply again. The law does not prohibit that. So stop blaming unfair laws.
So the only reason why a lot of us are in EB3 is becasue we have chosen to stay with the current employer who pays us well and do not want to take the risk of a new employer. So it is our choice and not injustice. The system allows us options. We cannot want a cake and eat it too. I am also trying to find a new employer to change my job and file in EB2. Everyone is free to do that.
And stop claiming that you are fit for EB2 but are stuck in EB3. If you are fit for EB2 then why don't you apply in EB2? If you have a masters degree you can find a new job with EB2 that needs a masters degree. Anyone who does not have masters degree then get work experience and change your job to file in EB2. Ultimately we have to decide what we want.

Just because the system provides 100 loopholes/opportunities/possibilities, does not mean one has to explore everything to get justice from the system. As I said, not EVERYONE can do that.
